Child Support Faker Claims Brain Tumor

In a legal defense move straight out of every soap opera defense attorney’s playbook, psychologists testifying on behalf of Viola Trevino say she can’t be guilty because she has a brain tumor. New Mexico station KOB 4 is reporting on this local case that has drawn national attention.

You may remember the case of Trevino, who bilked her ex-husband out of more than $20,000 in child support for a child it was later proven did not exist. The jig was up in 2004 when Trevino presented someone else’s child to the court as her own. That ended an elaborate ruse including fake DNA tests to convince a judge she deserved child support.

Trevino was in court again yesterday where an expert witness testified that the woman suffers from a brain tumor limiting her mental capacity. That doctor estimates she has an IQ of only 71, making her incapable of thinking up such a scheme. Doctors also claim that while at some point during the debacle Trevino had to know it was fake, she now believes “Stephanie” is her flesh and blood.

Ah, the brain tumor defense. Even if that gets Trevino off the hook, what’s the excuse for the numerous officials in the system that let this happen? Brain tumors aren’t contagious, are they?
